These General Conditions of Sale (hereinafter "GCS") apply to all orders for products or services placed by customers (hereinafter "Customers" or "you/your") by e-mail or through our Site.

 

1. ENFORCEABILITY OF THE GCS

 

The fact of using our Website and placing an order with WATCH HUB implies your full and unconditional acceptance of the following conditions:

 

- GCS;

- Legal Notice ;

- Terms of Use;

- Privacy Policy;

- Cookies Management Policy.

 

in force on the day of the order, as well as to the laws in force, to the exclusion of any other documents or advertisements issued by WATCH HUB and which have only an indicative value.

 

No special conditions may, unless formally accepted by WATCH HUB, prevail over these GCS.

 

The Customers, prior to his/her order, declares to be of age or with the authorization of his/her legal representatives, and to have the full legal capacity, allowing him/her to commit himself/herself under these GCS and his/her order towards WATCH HUB.

2. THE SERVICES

 

Our services are presented on our Website on the following page: pricing plans so that the Customer can read all the details of our services before ordering.

 

The information, photographs, diagrams, drawings or video films illustrating the services and the presentation of the services on our Website do not constitute an offer in the legal sense of the term, only the order placed between You and Us constitutes an offer.

 

If errors have occurred in the presentation of the services or if a service is no longer available, WATCH HUB cannot be held liable under any circumstances.

 

The services offered on our Website are subject to change without notice.

3. ORDER

 

All orders must be preceded by the Customer's validation of these GCS.

 

To place an order, the Customer must add the selected plans to a shopping cart. The shopping cart summarizes the selected plan, as well as its price. You can modify or delete the plan added to your shopping cart at any time before confirming your order.

 

To place an order, you must follow the following steps:

 

1. Adding the service to the shopping cart: you must click on "Next" to access the next step;

 

1. Review your order: you can view, check your shopping cart, possibility to change the services and total of the order, you must click on "proceed to checkout" to access the next step;

 

1. Billing: you must complete the form to add your billing information and create an account. Verification of information. You must click on "Confirm" to go to the next step;

 

1. Payment: Summary of the order (which can no longer be modified at this stage), you must choose the payment method. You must click on "place order" to proceed with the payment. You are then redirected to the secure page of the chosen payment service to pay for the transaction;

 

1. Order Confirmation: Page confirming your order and payment.

 

After your payment, you will receive an e-mail summarizing the essential information of your payment.

If for any reason beyond WATCH HUB's control WATCH HUB is unable to offer the ordered service, and plan, we will send you an e-mail as soon as possible.

 

Finally, WATCH HUB reserves the right to refuse any order for legitimate reasons, and in particular without this list being exhaustive, in the event of fraud, attempted fraud, or in the event of a payment incident.

4. TERMS OF PAYMENT

 

All orders must be paid in full as soon as the Customer confirms the said order, according to the payment methods proposed by WATCH HUB on the Website.

 

WATCH HUB guarantees full confidentiality of bank information secured by the SSL protocol, which automatically checks the Customer’s right to use the bank card and encrypts all transactions to ensure confidentiality.

 

WATCH HUB is not responsible for technical failures of these payment tools.

 

WATCH HUB reserves the right to refuse an order, in particular in the event of payment refused by the banking institution.

 

The currency used for the transaction is the Swiss Franc (CHF). The amount debited from the account of the bank card used will depend on the exchange rate of CHF on the day of the debit and any exchange fees charged by the bank issuing the card.

The invoice corresponding to the order placed is available in the "My Account" section.

5. PRICE

 

The prices displayed on the Website are those in force on the day of the order by the Customer.

 

We reserve the right to adjust the prices that we may determine at our sole discretion, at any time and without notice.

 

The prices are indicated on the Website are in Swiss Francs (CHF), VAT included.

6. DURATION

 

The Customer may subscribe for a fixed period by signing up for a subscription, within the limits of what is offered by WATCH HUB.

 

The type of subscription and period of use is stated in the order.

7. LIABILITY

 

WATCH HUB regularly updates its Website. The volume of information therein is constantly changing. WATCH HUB cannot, however, be deemed responsible for any omissions, inaccuracies or errors in this data or resulting consequences for the Customer.

 

Within the limit permitted by law, WATCH HUB 's liability in respect of the Customer is limited, for all types of damages, to the amounts effectively received by WATCH HUB from the Customer for the contractual period giving rise to the event that generated liability, except in the case of gross or willful misconduct. The Customer acknowledges that the agreed price reflects this distribution of risk and the limitation of liability resulting from it.

8. FORCE MAJEUR

 

All circumstances outside the control of the oarties, preventing the performance of their obligations under normal conditions, shall be considered grounds for releasing the parties from their obligations and shall lead to their suspension. The party that invokes the circumstances referred to above shall immediately notify the other party of their occurrence, and also of their disappearance.

 

All unavoidable events and circumstances, external to the parties, unforeseeable, inevitable, outside the control of the parties and which cannot be prevented by the latter, despite all reasonably possible endeavors, shall be deemed cases of force majeure. The unavailability for any reason whatsoever of the WATCH HUB Website or services due to a cause that is external to WATCH HUB is expressly considered to be a case of force majeure.

9. TERMINATION

 

In the event of the Customer's breach these GCS, order, or any other terms and conditions, WATCH HUB reserves the right to terminate the contract at any time and without compensation, in particular

in the event of non-compliance by the Customer with WATCH HUB 's intellectual property rights.

10. PROTECTION OF DATA AND COOKIES

 

In terms of data protection, please refer to and comply with our Privacy Policy and Cookies Management Policy.

11. SEVERABILITY

 

Any provision of the GCS which is in total or in part contrary to Swiss mandatory law shall be severable and any invalidity, in whole or in part, of such a clause shall not affect the validity of the remainder of the clause in question, nor of the other clauses of these GCS.

 

The fact that WATCH HUB does not at any given time invoke any of the provisions of these GCS and other conditions shall not be construed as a waiver of any such conditions at a later date.

12. APPLICABLE LAW AND JURISDICTION

 

The GCS are governed by Swiss law, without regard to the principles of conflict of laws.

 

In the event of a dispute concerning the interpretation, execution or termination of the GCS, we encourage you as a matter of priority to contact us in an attempt to resolve the dispute amicably.

 

WATCH HUB hereby notifies the Customer that there are alternative dispute settlement options such as mediation. EU’s Customers might for example contact the platform of amicable solution to the dispute of the European Commission available at http://ec.europa.eu/consumers/odr/.

 

If the dispute cannot be settled amicably, you agree with us to bring the dispute before the Courts of the Canton of Neuchâtel (SWITZERLAND), subject to recourse to the Federal Court.

 

The terms of this article do not deprive consumers of their right to take legal action, or to defense in the event of legal action, in their country of residence or domicile, or of their right to consumer protection measures as set out in the legislation applicable in their country of residence.

 

 

13. MODIFICATIONS

 

WATCH HUB reserves the right to make changes, revisions, corrections and/or improvements to the content of the Website, including all the conditions governing the Website, as well as these GCS, at any time without notice, but does not take responsibility for them.
